Children’s and Minors’ Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information.

       Demographic information, such as date of birth, age, and gender.

       Social networking information, such as usernames, handles, and friend lists.

       Location information, including general geographic location such as country, state or province, or city and precise geolocation, if you have enabled and consented to location information collection.

       Content and information you elect to provide as part of your profile or in any reviews you make through the Services or emails, chats, or other communications sent to us.

Some of the information identified above, including identification document information and geolocation information, may be considered sensitive data under certain laws. Automatically Through Our Services

       Klaviyo, an email and SMS marketing application.

       Growave, which provides the Company’s loyalty program.

       Google and YouTube, which provide additional search and video options relating to the Company’s products.

       PageFly Page Builder, which assists the Company in building its website.

       Pinterest, allows individuals to find Company products on Pinterest.

       BOGOS.io Free Gift, assists in providing free items with purchase.

       Lucky Orange Heatmaps & Replay, assists in turning customer behavior into readable information for the Company.

       Recharge Subscriptions, assists in the Company’s subscription model.

 

These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal data or they may collect information, including personal data, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

If you do not want us to share your personal data with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt out by logging into your account and adjusting your account settings and preferences or sending us an email stating your request to support@kayanoya.com. We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Location data choices:

       Location Data. You can choose whether or not to allow the Services to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some Services features may become inaccessible or not function properly.

Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

 

        Right to Confirm:

You may have the right to confirm whether or not we process your personal information.

        Right of Access (Data Subject Access Request):You may have the right to ask us for a copy of the information we hold about you at any time, and request us to modify, update or delete such information. If we provide you with access to the information we hold about you, we will not charge you for this unless permitted by law. If you request further copies of this information from us, we may charge you a reasonable administrative cost.  Where we are legally permitted to do so, we may refuse your request.  If we refuse your request, we will always tell you the reasons for doing so.

If you would like to request access to your information, it would assist us with dealing with your request if you could use the subject heading ‘Data Subject Access Request’ when contacting us. Please note that this is not mandatory, and we will still deal with any requests without this reference.

        Right of Correction: You may have the right to request that we rectify any inaccurate or incomplete personal information that we hold about you. If we have shared this personal information with third parties, we will notify them about the rectification unless this is impossible or involves disproportionate effort. You may also request details of the third parties to whom we have disclosed the inaccurate or incomplete personal information. Where we think that it is reasonable for us not to comply with your request, we will explain our reasons for this decision.

        Right to Deletion: You may have the right to request that we erase your personal information in certain circumstances. Normally, this right exists where:

o    the data is no longer necessary;

o    you have withdrawn your consent to us using your data, and there is no other valid reason for us to continue;

o    the data has been processed unlawfully;

o    it is necessary for the data to be erased in order for us to comply with our obligations under law; or

o    you object to the processing of your data and we are unable to demonstrate overriding legitimate grounds for our continued processing.

We would only be entitled to refuse to comply with your request for erasure in limited circumstances and we will always tell you our reason for doing so.

When complying with a valid request for the erasure of data we will take all reasonably practicable steps to delete the relevant data.

        Right to Restrict Processing: You may have the right to request that we restrict our processing of your personal information in certain circumstances, for example if you dispute the accuracy of the personal information that we hold about you, you object to our processing of your personal information for our legitimate interests or you require us to keep it in connection with legal proceedings. If we have shared your personal information with third parties, we will notify them about the restricted processing unless this is impossible or involves disproportionate effort. We will, of course, notify you before lifting any restriction on processing your personal information.

We may only process your information while its processing is restricted if we have your consent or are legally permitted to do so, for example for storage purposes, to protect the rights of another individual or company or in connection with legal proceedings.

        Right to Object: Depending on your location, you may be able to object to us processing your personal information where we do so for one of the following reasons:

o    to enable us to perform a task in the public interest or exercise official authority; or

o    to send you direct marketing materials and where your right to withdraw consent does not apply.

Except for the purposes for which we are sure we can continue to process your personal information, we will temporarily stop processing your personal information in line with your objection until we have investigated the matter. If we agree that your objection is justified in accordance with your rights under data protection laws, we will permanently stop using your personal information for those purposes. Otherwise, we will provide you with our justification as to why we need to continue using your personal information.

        Right to Data Portability: You may have the right to transfer your personal information between service providers where we rely on your consent or the performance of your contract as the lawful basis to use that information. To allow you to do so, we will provide you with your data in a commonly used machine-readable format so that you can transfer the data. Alternatively, we may directly transfer the data for you if technically possible.

 

        Right to Withdraw Consent: Depending on your location, and where we have obtained your consent to process your personal information for certain activities (for example, for marketing), you may be able to withdraw this consent at any time. If you are able to withdraw consent, we will cease to use your personal information for that purpose unless we consider that there is an alternative legal basis to justify our continued processing of your data for this purpose, in which case we will inform you of this condition. If you withdraw your consent, our use of your personal information before you withdraw is still lawful.

        Rights relating to Automated Decisions: In certain circumstances, you may have the right to contest a decision made about you based purely on automated processing and where the processing is not required by law. You may also ask us to stop making such decisions using automated processing alone.

 

        Right to Complain: If you would like to make a complaint or if you have any questions about how we use or keep your personal information, you may contact us using the contact details in this policy.

You may have the right to lodge a complaint with the relevant supervisory authority for your jurisdiction (e.g., your state attorney general’s office), if you believe our processing of your personal information violates applicable law.

        Authorized Agent: Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us on the details provided below.

 

        Opt-Out of Profiling: You may have the right to opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects, including automated decisions.

 

        Opt-Out of Targeted Advertising: You may have the right to opt-out of personal data processing for targeted advertising purposes.

        Opt-Out of Sale: We do not currently sell the personal information of its consumers.  However, if we do sell any personal information, you may also have a right to opt-out of certain personal information sales. 

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

Upon receiving your request, we will need to verify your identity to determine you are the same person with whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data "sales" as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Non-Discrimination

The Company will not discriminate against you for exercising any of your privacy rights. Exercising your rights will not result in denial of services, reduced quality of services, or different pricing.

How We Protect Your Personal Data

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.

How We Retain Your Personal Data

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. Notice of Financial Incentive/ Bona Fide Loyalty Program Disclosure

We offer our customers a loyalty program (the Kubara Honke Loyalty Program) that provides certain perks, such as rewards and exclusive offers. We may also provide other programs, such as sweepstakes, contest, or other similar promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. Under the California law, the value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.

We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law.
